Background Checks / Clearances

 

Pennsylvania Act 153 of 2014 requires that all adults who have contact with students, including paid employees and unpaid volunteers, complete comprehensive criminal and child abuse background checks that are kept current and on file with the district.

 

To ensure proper verification and compliance with state law, the following procedures apply:

  • Clearances must be submitted directly to the Superintendent’s Executive Assistant at least seventy-two (72) working hours prior to an individual’s start date to allow sufficient time for review, verification, and approval to start. Merely stating that one has clearances in their possession or on file elsewhere is not sufficient. Clearances must be on file with the District and formally approved before an individual is permitted to work or volunteer in any capacity.

  • No individual may begin working or volunteering until written confirmation is received indicating that all required clearances and paperwork have been reviewed and approved by the Superintendent’s Executive Assistant.

  • Because these documents contain personally identifiable information, all clearances must be submitted or delivered directly by the individual to the Superintendent's Executive Assistant and may not be shared with or routed through other District employees or administrators. If a third party or District employee possesses copies of an individual’s clearances, the individual must provide written authorization permitting the third party to release the documents to the District Superintendent’s Executive Assistant, in accordance with Pennsylvania State Police auditing guidelines.

 
CLEARANCE INFORMATION
 
ACT 34 CLEARANCE (PA Criminal Background Check)
Must be renewed every five (5) years.
 
ACT 151 CLEARANCE (PA Child Abuse History)
Must be renewed every five (5) years.
 
ACT 114 CLEARANCE (Federal Criminal History Background Check)
Must be renewed every five (5) years.

*The above Service Code is for Employees per the PA Department of Education. There is a service code for VOLUNTEERS, however the fee for a volunteer FBI clearance is $1.00 less than the fee to obtain the same clearance for employment purposes. If you obtain a volunteer FBI background check, you are NOT able to use it for employment purposes and will have to pay for another background check should the need arise. Therefore, it is recommended to use the Employee Service Code.
 
ACT 126 TRAINING (THERE ARE TWO PARTS TO THIS TRAINING; BOTH ARE MANDATORY)
Must be renewed every five (5) years.
 
Part I: Child Abuse Recognition and Reporting Training - University of Pittsburgh (FREE)
You must complete the online course, Recognizing and Reporting Child Abuse: Mandated and Permissive Reporting in Pennsylvania Online Training at PA Child Welfare Resource Center - Pitt. 
Register by clicking on "Registration" in the upper left-hand corner. Then, follow the directions to complete the required information and submit. There is no cost to take the online course. 
 
Part II: Professional Ethics and Educator Discipline Act - PDE SAS (FREE)
The course is available on the Department of Education's SAS Portal. Participants who do not have a SAS account must first register for one by visiting PDE SAS. Once logged in, select PD Center from the dropdown menu in [Your Name]'s SAS Tools in the upper right-hand corner. Select Course Catalog/Registration from the "Menu" dropdown in the upper right-hand corner. Under "Course Options" on the left, check Act 126. Register for the Educator Discipline Act 126 track that applies to you. (i.e. Chief School Administrator, Staff, or Teacher Track)
 
ACT 24 FORM (PDE-6004: Self-Reporting Arrest/Conviction Form)
SCHOOL PERSONNEL HEALTH RECORD (Including Tuberculosis Test Results less than 3 Months old)
Required for School Personnel who provide direct services to students on behalf of a school, including but not limited to teachers, nurses, administrators, custodians, janitors, cooks, cafeteria workers, bus drivers, librarians, psychologists, counselors, and student teachers and volunteers.
ACT 168 FORM (Sexual Misconduct/Abuse Disclosure Release)
For new hires only, a Sexual Misconduct/Abuse Disclosure Release Form must be filled out and returned to the Administration Offices for:
(1) Current Employer, regardless of whether the employer is a school entity and/or whether the applicant is employed in a position that involves direct contact with children;
(2) All former employers that were school entities (regardless of job title); and
(3) All former employers where the applicant was employed in a position that involved direct contact with children.

**Per Act 15, FBI (Fingerprint/Federal Criminal History) is NOT required if: 1) the volunteer has been a resident of the Commonwealth of PA during the entirety of the previous ten (10) year period (waiver form required); or 2) if not a resident of the Commonwealth of PA - during the entirety of the previous ten (10) year period, but has received a FBI clearance/certification at any time since establishing a residency in the Commonwealth of PA and provides a copy of the clearance/certification.
